But a decision in the second case, on access to emergency abortions, may have much more profound consequences, both for November’s election and the ongoing struggle over reproductive rights. At issue is whether EMTALA requires physicians to offer emergency abortions even when state abortion bans — including those enacted after the overturning of Roe — do not permit them. The Biden administration brought suit against Idaho in federal court, arguing that federal law does pre-empt state policy on the matter. In such states, emergency rooms “are so scared of a pregnant patient, that the emergency medicine staff won’t even look. They just want these people gone,” Sara Rosenbaum, a health law and policy professor at George Washington University, told The A.P.

We’re looking back at the strongest, smartest opinion takes of the week from CNN and other outlets. In a video promoting the Bible, Trump said, “Religion and Christianity are the biggest things missing from this country. … we need to bring them back.”On Good Friday, Trump posted a very different kind of video. It showed an image of President Joe Biden lying sideways and tied up in the bed of a pickup truck. “Robert F. Kennedy Jr.’s independent presidential campaign can’t win, but it could swing the presidency to former President Donald Trump,” Begala wrote.

mary zieglerWell, I think it’s much easier to ban abortion than it is to enforce a criminal law against abortion. mary zieglerNo, I think that’s right. If our abortion politics don’t reflect our abortion views, what does that tell us about the health of the democracy? We’ve seen upwards of 10 states — I think it’s 14 or 15 that have changed their definition of abortion in abortion restrictive states since Dobbs. So, the idea is that abortions that are presented as life saving either are not abortions or are simply pretexts for abortion that’s elective.

With Donald Trump seemingly unstoppable in his bid for the Republican presidential nomination, the law professor Mary Ziegler considers what a second Trump term would mean for abortion rights. In this audio essay, she argues that while Trump may seem indifferent on the campaign trail to tightening abortion laws, there is a real possibility that if re-elected he will seek to appease his base by using his executive power to ban abortions nationwide. (A full transcript of this audio essay will be available within 24 hours of publication, and can be found in the audio player above.)

For many Americans who support abortion rights, the election in November will most likely come down to a choice between voting for President Biden and staying home. They won’t vote for the man who ensured Roe v. Wade’s demise, but many of them are unenthusiastic about the prospect of Mr. Biden being the Democratic nominee. What is plausible is that, returned to the White House, Donald Trump would seek to use his executive power — power that his allies are aiming to increase on his behalf — to further curtail abortion access. He might seem uninterested in doing much of anything about abortion now, on the campaign trail, which is a shrewd political move, given how unpopular abortion bans have proven to be since Roe’s reversal. And Mr. Biden and Ms. Harris would be wise to make clear to voters the real risks of a second Trump presidency for abortion access.

We’re looking back at the strongest, smartest opinion takes of the week from CNN and other outlets. CNN —On the day after Republicans lost pivotal races in Kentucky, Ohio and Virginia last week, Rep. Marjorie Taylor Greene offered a diagnosis for her party’s ills. On Tuesday, Ohio voters passed an amendment to the state constitution that guarantees abortion rights. The disconnect may or may not cost Trump votes in 2024, but it’s hurting Republicans up and down the ballot. “Democrats will win in 2024 by making the election a choice, not just a referendum on Biden’s performance in office.

The bill has since been misinterpreted due to language surrounding the phrase “perinatal death” in one of its sections (here). Perinatal death, by one of three definitions by the American Academy of Pediatrics published in May 2016, is the fetal death starting at gestation of 20 weeks and ending at infant death up to 28 days of age (see “Definitions” section on “perinatal death”) (here). BILL AMENDEDThe bill’s language on “perinatal death” was amended twice in assembly before reaching the state senate (see different versions of the bill) (here). BILL DOES NOT DECRIMINALIZE INFANTICIDELaw professors on reproductive health consulted by Reuters said the bill does not decriminalize infanticide and the amendment sought to limit misinterpretation of its language. A California reproductive health bill does not legalize infanticide or killing babies up to 28 days old.

Opinion: A boast that could sink Trump

We’re looking back at the strongest, smartest opinion takes of the week from CNN and other outlets. CNN —“I’m the one that got rid of Roe v. Wade,” former President Donald Trump boasted Tuesday on Newsmax. Congress has the power to rein in the court, wrote CNN legal analyst and law professor Steve Vladeck, whose new book “The Shadow Docket” focuses on the Supreme Court. Courtesy Boaz FreundIn 2019, then-President Trump issued an executive order requiring hospitals to post the prices of common medical services and procedures. For some, its celebration of a multiracial but purely fictional British aristocracy may even be a big part of its appeal.”As escapism, “Queen Charlotte” is a success.
“Comstock is really the backdoor way to remove access to abortion across the whole country,” said Greer Donley, a University of Pittsburgh Law School professor who specializes in abortion law. Severino argued that, at least when it comes to the Comstock Act’s prohibitions on mailing abortion pills, Congress is well within its powers to regulate those shipments. Several towns, some in New Mexico and elsewhere, have passed local ordinances that cite the Comstock Act and prohibit business within those jurisdictions from shipping or receiving items used for abortions in the mail, as covered by the Comstock Act. The lawsuits in New Mexico state court that those ordinances have prompted may provide for another opportunity for courts to elaborate on what the Comstock Act means. The Supreme Court, in the emergency order it issued last week, did not say anything about the Comstock Act.
Opinion: Top secrets come spilling out

We’re looking back at the strongest, smartest opinion takes of the week from CNN and other outlets. Writing for CNN Opinion, Rep. Justin Pearson noted, “This should be a chastening moment for revanchist forces in Tennessee’s legislature and across the country. Over the long haul, the undemocratic machinations employed to oust us from office are destined to fail. Dr. Martin Luther King, Jr. once famously said that the moral arc of the universe bends toward justice. “As a Jewish historian,” Perry wrote, “I worry about the tension between preserving the memory of past hardships while not locking our entire history into a tale of oppression.
The Alliance For Hippocratic Medicine wants Judge Kacsmaryk to nullify the FDA's medical approval of mifepristone, which would effectively ban the abortion pill across the US. They argue plaintiffs are skirting the usual process of assigning cases randomly — which is mainly intended to "avoid judge shopping," as one federal court explains. Medication abortion is the most common form of the procedure in the U.S.An attorney for the ADF has rebuffed accusations of judge shopping. Trump was accused of judge shopping for Florida federal Judge Aileen Cannon, whom he appointed, when he filed a sweeping lawsuit in 2022 against his former political rival Hillary Clinton in Cannon's division in Florida. Ziegler echoed the view that even the appearance of judge shopping can erode trust in the courts.
CNN —Dueling decisions in two federal district courts last week are likely to set up a showdown at the Supreme Court over the fate of the abortion pill mifepristone. When the Supreme Court upheld the federal Partial-Birth Abortion Ban Act in 2007, dubious scientific arguments became even more central to anti-abortion advocacy. In Gonzales v. Carhart, the court held that in circumstances of scientific uncertainty, legislators would have more latitude to regulate abortion. Implausible scientific claims are now visible on social media, in lawsuits and in congressional hearings. (By taking this position, abortion opponents can still defend bans with no or few exceptions by claiming that abortion is never necessary.)
Opinion: Texas judge’s stunning ruling caps extraordinary week

We’re looking back at the strongest, smartest opinion takes of the week from CNN and other outlets. Tennessee legislators targeted three members of the state House for joining a gun control protest in the chamber, expelling two young Black men while failing to oust a 60-year-old White woman. (He gave the Biden administration a week to appeal the ruling before it goes into effect. Thus, the week that began with Trump facing a judge in Manhattan ended with a Trump-appointed judge overturning more than two decades of medical practice. “They go far too fast to be safe on the sidewalk” and aren’t right for bike lanes or roads either.
But abortion-rights advocates say legal exceptions do nothing but make abortion bans appear more reasonable than they really are. One shows states with abortion bans with exceptions for rape or incest and the other shows states without those exceptions. One shows states with abortion bans with exceptions for fatal birth defects and the other shows states without those exceptions. One shows states with abortion bans with exceptions for patients with severe health risks and the other shows states without those exceptions. One shows states with abortion bans with exceptions for the life of the patient and the other shows states without those exceptions.
